Terms of Service

1. Acceptance of Terms

By installing, accessing, or using Trakit - AI Ads Tracker(the "App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you must immediately uninstall and cease using the App.

2. Description of Service

The App provides Shopify merchants with attribution telemetry, referral token capture (such as OpenAI oppref tokens), and server-side Conversions API (CAPI) dispatches for emerging AI advertising channels and conversational search engines (including OpenAI / ChatGPT Ads, Perplexity, and Google Gemini).

3. Merchant Eligibility & Obligations

By using the App, you warrant that:

• You maintain an active Shopify store in good standing and adhere to Shopify's Merchant Terms and Partner guidelines.
• You hold valid, authorized credentials for any AI advertising networks connected to the App.
• Your store's published privacy policy clearly informs visitors regarding conversion attribution and telemetry technologies.

4. Subscription Billing & Cancellations

All fees and recurring subscriptions are processed exclusively through Shopify's official Billing API and will appear directly on your regular Shopify invoice:

• If a free trial is offered, charges will automatically commence upon trial expiration unless cancelled beforehand.
• You may cancel your subscription at any time by uninstalling the App from your Shopify admin. Cancellation takes effect immediately.

5. Third-Party AI Platform Terms

You acknowledge that AI platforms (OpenAI, Google, Perplexity) maintain independent developer terms, advertising policies, and API rate limits. Trakit is not liable for campaign disapprovals, API rate limits, or account policies imposed by third-party AI platforms.

6. Service Availability & Disclaimer

The App is provided on an "AS IS" and "AS AVAILABLE" basis. While we strive to maintain 99.9% uptime, we do not guarantee that the service will be uninterrupted or error-free.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Trakit or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, ad spend, revenue, or business data. Our total aggregate liability under these Terms shall not exceed the amounts paid by you for the App during the three (3) months preceding the claim.

8. Termination

You may terminate this agreement at any time by uninstalling the App. We reserve the right to suspend or terminate access if you violate these Terms or misuse the service.
